On his return to Chambers following his posting at the International Criminal Court ‘s (ICC) Office of Public Counsel for the Defence, the first part of James Onalaja’s two-part article analysing the criticisms of the ICC Prosecutor’s applications for arrest warrants in the Palestine Situation is published in ‘Counsel’, the Journal of the Bar of England and Wales.
Part-one of the article, published in September’s issue of Counsel Magazine (out now both in print and via the link below) reviews the alleged basis for the charges of War Crimes and Crimes Against Humanity and analyses the criticisms re: timing, jurisdiction, impact of the Oslo Accords and alleged false moral equivalence.
Part-Two of the article will be published in the October issue of Counsel Magazine and will address amongst other matters: the allegations of bias, potential evidential challenges, alleged failure of complementarity and the potential impact of immunities.
