The appellant was convicted in 2023 of the Murder of his father. The partial defence of loss of control was withdrawn from the jury there being insufficient evidence to support that contention. An application by D to give further evidence in support of that defence was refused. The appeal against conviction was dismissed on both grounds. An unusual feature of the case was that in 2025 another offender was convicted as an accessory to the Murder by encouraging the appellant to commit the offence. The appellant claimed that the subsequent conviction of another party assisted his claim of loss of control. The Court of Appeal disagreed.
