Unanimous Acquittal in High-Profile West End Club Allegation

Sean Kivdeh,  Kate Davey and Mark Tomassi successfully defended their three respective clients charged with rape. This was a highly sensitive and serious case where these young men were accused of rape following an incident alleged to have occurred after a night out in a West End nightclub. The case, involving five defendants in total, was heard over three weeks at Southwark Crown Court. All 5 defendants were acquitted.

The trial turned on detailed analysis of extensive CCTV footage from inside and outside the club, along with forensic examination of social media messaging. After careful scrutiny, the jury returned unanimous not guilty verdicts in under two hours.

Miss Davey’s client, along with one other defendant, was discharged at the close of the prosecution case following her successful submission of ‘no case to answer’. The defence teams highlighted serious flaws in the police investigation and inconsistencies in the prosecution evidence.

This complex and sensitive case required significant pre-trial preparation, including detailed review of video material and digital communications.
