Defendant Acquitted after Prosecution Witness Refuses to Return to Court for Mitch Cohen to Continue Cross Examination

Mitch Cohen was defending LM at Huntingdon CC. He was charged with a s18 wounding with a knife and running self-defence. It was said that he had caused serious wounds to both the complainant’s legs with graphic photographs of those wounds being available to the jury.

Mitch started to cross examine the complainant on Tuesday afternoon , was showing him to be aggressive, argumentative and that he was not being truthful. He said, after the Judge was also critical of the way that the complainant was argumentative and interrupting questions, that he could not continue as he was feeling unwell.

The complainant was put up in a hotel overnight but, the next day, failed to attend Court and instead made his way home. The Judge insisted that he return to complete his evidence, but he refused to do so, despite a further overnight adjournment to allow him to attend.

The Prosecution offered no evidence when refused a further adjournment and Not Guilty verdicts were returned on the judge’s direction.
