28 October 2024

James Onalaja

The second part of James Onalaja’s two-part article analysing the criticisms of the International Criminal Court (ICC) Prosecutor’s applications for arrest warrants in the Palestine Situation is published in this October’s issue of ‘Counsel’, the Journal of the Bar of England and Wales.

Following September’s publication of the first part of James’ article, part-two addresses amongst other matters: the allegations of bias in the investigation and prosecution; potential evidential challenges; alleged failure of complementarity; the potential impact of immunities; the potential impact of the arrest warrants on states supplying arms to parties to the conflict; and the potential impact of the arrest warrants on steps to secure an end to the current hostilities.

Part-Two of the article is out now both in print and online and may be freely accessed here: https://www.counselmagazine.co.uk/articles/arrest-warrants-in-the-israel-palestine-situation-2-
