Rebecca Lee made a successful application to stay as an abuse of process a prosecution of allegations of historic child sexual abuse (dating to 1985) at Chester Crown Court. There had been a contemporary investigation, in respect of which no records whatsoever had been retained. The Judge ruled that it would be impossible for the defendant to have a fair trial.
