Mark Tomassi Secures the Acquittal of a Man Charged with Gang Rape Following a Ten Week Trial

Mark Tomassi, acting on his own, secures the acquittal of a man charged with gang rape following a ten week trial. The matter was contested on every important issue including the alleged timeline and the effects of consumption of alcohol. The prosecution were confronted with a large catalogue of mistakes regarding the inadequate police investigation, including an admission of neglect of duty.   

The trial process demonstrated the need for focused expert submissions on section 41 Youth Justice and Criminal Evidence Act  and the need to challenge prosecutorial assertions of incapacity. Toxicology and confabulated memory syndrome featured prominently in the case.
