Daniel Kersh secures the acquittal of a client accused of rape and incest relating to his then 15-year-old daughter. The trial at Kingston Upon Thames Crown Court lasted 4 weeks.

The Prosecution’s case centred upon the daughter’s several VRIs, together with a photo containing the defendant and complainant engaged in a sexual act. They also relied upon hundreds of messages extracted from the defendant’s phone. The defence were able to present an alternative narrative of a deeply complex complainant, who had formed an unhealthy obsession with her father, that he was desperately attempting to manage. The jury ultimately sided with the defendant.

The Judge, in discharging the jury, thanked them for their service and observed that the case was one of the most challenging and complex cases he had ever presided over.
